Right of Withdrawal
A. Withdrawal Policy
Introduction
Consumers are entitled to a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, acquired possession of the last item of goods.
To exercise your right of withdrawal, you must inform us (Erol Mayreder, B.T.C., Bandgasse 33-41/3, 1070 Vienna, Austria, Tel.: +43 681 110420483, Email: hello@beyond-the-clouds.com) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, although it is not mandatory.
You may also exercise your right of withdrawal online via the website at https://beyond-the-clouds.com/apps/widerruf. If you use this online option, you will promptly receive an acknowledgment of receipt on a durable medium (e.g., by email), containing information about the content of your withdrawal declaration as well as the date and time it was received.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever occurs first.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion or Early Expiry of the Right of Withdrawal
The right of withdrawal expires prematurely in the case of contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.
The right of withdrawal does not apply to consumers who, at the time of conclusion of the contract, are not nationals or residents of a Member State of the European Union and whose sole place of residence and delivery address at the time of conclusion of the contract are located outside the European Union.
